Terms and Conditions

PRELIMINARY NOTE

For reasons of better readability, the masculine form is used for personal designations and personal nouns in these General Terms and Conditions (“GTC”). In the interests of equal treatment, corresponding terms apply to all genders and gender identifications of any kind. The abbreviated language form is for editorial reasons only and does not imply any judgment.

GENERAL

touch and go Paragliding GmbH (the flight school touch and go…) offers paragliding training, advanced training courses, flight trips and tandem flights as well as paragliding equipment and accessories according to the latest standards. Our offers are only available to a person (customer) who has read, understood and accepted every point of these terms and conditions. A contract between the customer and the touch and go… flight school is concluded when the booking is accepted by the touch and go…. flight school. These general terms and conditions form an integral part of this contract. The participant assures with his registration that he is physically and mentally healthy and that there are no illness-related reasons that exclude suitability for participation. The participant is responsible for good footwear and suitable clothing. He undertakes to strictly follow the instructions of the flight instructors and course leaders. No one is forced or obliged to take off. If a participant feels unsafe or unwell, they should report this to the launch manager or flight instructor. A training day may be postponed or canceled for safety reasons. Young people under the age of 18 require the signature of their legal representative.

DISCLAIMER

Participants are aware that they are taking certain risks when practicing the sport of hang gliding. Participation in paragliding training, further training, flying trips, tandem and test flights is always at the participant’s own risk and responsibility. Liability of the touch and go… flight school , its instructors, tandem pilots and other auxiliary persons for damage to participants is expressly excluded. touch and go .. . accepts no liability for damage to or theft of personal equipment in touch and go… vehicles (including trailers). touch and go… accepts no liability for damage caused by the actions of third parties, other participants, natural events, etc. or resulting from delays in the flight program.

INSURANCE AND DAMAGE TO THE MATERIAL OF touch and go…

The touch and go… flight school is insured for its activities as part of its duty of care. The flying equipment of touch and go… is also insured on a lump-sum basis for air-related causal liability. However, if a course participant uses their own flying equipment, their own valid flight liability insurance is mandatory (private liability insurance is not sufficient!). Damage to training and test equipment caused by the customer’s own fault shall be borne in full by the customer. Sufficient accident insurance is always the responsibility of the participant.

VOUCHERS

Gift vouchers for materials and all our services must be paid for before delivery. The vouchers expire 24 months after the date of issue. A redemption is excluded. Redemption after expiry is only possible by arrangement. A voucher is a security, in the event of loss there is no replacement and no equivalent value. In the case of service vouchers, the touch and go… flight school reserves the right to demand an additional payment if the price of the service has increased in the meantime.

COURSE COSTS / DURATION OF TRAINING

The prices of the offers are based on the current offers of the flight school touch and go… on the website https://paragliding.ch. Prices are quoted in Swiss francs. Prices are subject to change without notice.

The following time regulations apply to the course packages:
Basic training: The training flat rate is valid for 3 months from the first day of the course, a maximum of 5 course days are included.
High flights training: The training fee is valid for 12 months from the first day of the course for an unlimited number of flights.
Full licence course: The training flat rate is valid for 12 months from the first day of the course for an unlimited number of flights.
Restarters & extension of the school time: The flat rate includes 10 additional training days, valid for 12 months from the first day of the course.
Tandem 1: The training flat rate includes 10 solo training flights, 1 instruction flight including tandem equipment and 20 tandem training flights with your own equipment and is valid for 4 months from the instruction flight.
Tandem 3: The training package rate includes 30 tandem training flights with your own equipment and is valid for 6 months from the first day of the course.

After the end of the course or if the course is discontinued, any claims to course fees already paid expire.
Packages and continuation courses can be interrupted once for a maximum of 6 months free of charge in justified cases (e.g. illness, accident or stay abroad) with prior notification. Subsequent registrations are not possible. The training can be extended by paying the fee for the extension of the training period up to 12 months after the end of the course duration of the high-altitude course or the complete training at the latest.

Cancellation costs:

Cancellations before the start of the course will be charged a one-off processing fee of CHF 100. The course costs are non-refundable after the start of the course.

Implementation of the individual training days:

The planned training days can be found on the website https://paragliding.ch. The training days will be held if the weather is suitable and the minimum number of registrations is reached. If the planned course or training day is canceled or postponed due to the weather forecast or an insufficient number of participants, the first day of the course will be postponed to a later training day and the services not purchased can be purchased at this later date. Refunds are not possible. If a course has to be canceled prematurely due to weather conditions, there is no entitlement to a refund of the course fee, but the course can be rescheduled for a later date.

FLIGHT EQUIPMENT / MATERIAL RENTAL DURING TRAINING

The aim is for the student to be able to complete their high-altitude flights with their own flying equipment. The equipment rental for the first 3 high-altitude flight days is included in both the high-altitude flight course and complete training packages, after which the rental prices for equipment are charged according to the current prices on our website https://paragliding.ch.

If the flying equipment is brought in from outside, a surcharge of CHF 2,000 will be levied on the school fees for the high-altitude flight course and full training packages. This amount is made up of CHF 1,000 for the paraglider, CHF 500 for the harness and CHF 500 for the emergency parachute. The paraglider and harness must also be checked by a check center approved by the touch and go… flight school and the emergency parachute must be freshly serviced. The check and packing intervals for your own equipment specified by the touch and go… flight school must also be adhered to during the training period.

AIR TRAVEL / SAFETY TRAINING / FURTHER EDUCATION

Prices and services:

The prices and services of the offers are based on the current offers of the flight school touch and go… on the website https://paragliding.ch. Prices are quoted in Swiss francs. Prices are expressly subject to change. Special requests and special agreements are only part of the contract if they have been confirmed in writing by the touch and go… flight school. Unless otherwise stated in the invitation to tender, the services for air travel start from the agreed airport and for coach travel from the boarding point.

Cancellation costs are made up as follows:

Any costs for flight tickets must be paid by the participant in any case; for the remaining costs, the following cancellation costs apply if the trip is canceled within the following deadlines:

100 to 60 days before the start of the trip: 25% of the package price plus a processing fee of CHF 100
60 to 30 days before the start of the trip: 50% of the package price plus a processing fee of CHF 100
29 to 0 days before the start of the trip: 100% of the package price

A one-off processing fee of CHF 100 per person will be charged for cancellations before the start of the cancellation period. If a participant breaks off the trip prematurely for any reason, no refunds will be made. The date on which your written cancellation is received by the touch and goflight school is decisive for calculating the cancellation date. ..Cancellation insurance is strongly recommended, as this covers the cancellation costs in cases of hardship (e.g. illness, accident or force majeure).

Insurances:

The price of the touch and go… flight school does not include insurance. By starting the trip, the participant assures that he/she is responsible for all costs arising from accident or illness during the trip as well as for possible rescue and repatriation. Comprehensive insurance cover (cancellation costs, travel and accident insurance) is strongly recommended.

Responsibilities of the tour participants:

Participants are responsible for ensuring that their paragliding licenses are valid and that their flying equipment is airworthy and complete. If a participant does not meet these requirements (e.g. insufficient license, lack of an emergency parachute, helmet, etc.), the touch and go… flight school is entitled to refuse participation in the flying activities. The travel or course price paid will not be refunded. The participant carries out all paragliding flights under his own responsibility.

MATERIAL

We are happy to accept orders for material by e-mail. Telephone orders are placed at your own risk. Orders for custom-made products (e.g. special colors) will only be processed by the touch and go… flight school after receipt of payment.
Visible defects must be reported totouch and go… immediately upon receipt of the goods, hidden defects within 10 days of receipt of the goods.

All products are subject to the manufacturer’s original warranty. There are no warranty claims for second-hand products.

The paragliders’ (new goods) test flights are done by
touch and go… If the customer refuses this service, a corresponding waiver must be signed.

PAYMENTS

We generally offer the payment method invoice for courses, travel and material. In the case of payments from foreign accounts, any costs of a money transaction must be borne by the buyer.

The courses and trips are to be paid 10 days after invoicing, but at the latest by the start of the course or trip. Payments not made on time entitle the touch and go… flight school to refuse the services or to withdraw from the contract.

Invoices for materials must be paid within 10 days of the invoice date.

If payment is not made within 10 days of invoicing, the customer shall be in default. In this case, the touch and go… flight school reserves the right to charge the customer reminder fees in addition to the invoice amount. While no fees are charged for the first payment reminder, the reminder fees are CHF 10 for the first reminder and CHF 20 for the second and therefore last reminder. In addition to paying the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of the delay in payment.

HIKE & FLY

The hike/climb & fly offers (hikes, climbs and mountain tours which are combined with a paraglider for the descent) take place on a private basis and are carried out by certified paraglider pilots who are in possession of an official hang gliding license. Participants acknowledge that touch and go… and the contracted tour guide cannot guarantee absolute safety from the dangers of the mountains. The customer expressly accepts the risks associated with Hike/ Climb & Fly. touch and go… only commissions well-trained tour guides or paraglider pilots to lead these tours. touch and go… excludes all liability to the extent permitted by law. In particular, no liability is assumed for damages incurred by the customer due to negligent or willful misconduct on the part of the tour guide or paraglider pilot. Liability for the selection and instruction of the tour guide and paraglider pilot is also excluded. If the customer nevertheless asserts any claims for damages, the customer must assert these against the appointed tour guide or the lead paraglider pilot. The customer is responsible for his own personal insurance (in particular for comprehensive insurance cover in the event of accident and illness, including cover for mountain rescue costs). touch and go… recommends that customers take out cancellation insurance and Rega patron membership.

TANDEM FLIGHTS

General information:

The passenger expressly declares that he/she is physically and mentally healthy, does not weigh more than 100 kg, has no heart or circulatory disorders, balance problems, neurological disorders or other illnesses, including chronic illnesses, and feels able to cope with the strain of the flight. In any case, the activity in these cases takes place at the passenger’s risk. It is the passenger’s responsibility to cancel the flight if:
– no theoretical briefing has taken place.
– he or she has not understood all or part of the briefing.
– he or she is under the influence of alcohol, drugs or medication that impair his or her judgment and ability to act.

The passenger accepts the terms and conditions of the touch and go… flight school by sending the booking, paying the invoice amount, verbally placing an action order and / or signing / redeeming gift vouchers. The costs for photo & video service, transportation to take-off and the like are not included in the flight fee, but can be booked additionally.

It is the passenger’s responsibility to wear suitable clothing (weatherproof, windproof, dirt-repellent), sturdy shoes (reaching above the ankles) and tear-resistant gloves. The tandem pilot undertakes to provide head protection (helmet) and flight equipment. For passengers under the age of 18, the signatures of both parents/legal representatives are required.

It is the passenger’s responsibility to follow the pilot’s instructions unconditionally and without delay. This is for their own safety. In particular, failure to follow the instructions and directions during take-off, flight and landing may result in injury to the passenger and the pilot. If the pilot’s instructions are not followed, the pilot may exclude the passenger from the flight. In the event of non-compliance, the claim for reimbursement will be rejected. The passenger is liable for personal injury resulting from failure to follow the pilot’s instructions. The passenger is liable for intentional or grossly negligent damage to equipment, pilots or third parties caused by the passenger.

Prices and services:

The prices and services of the offers are based on the current offers of the flight school touch and go… on the website https://paragliding.ch. Prices are per person in Swiss francs. Prices are subject to change without notice.

Payment:

It is the passenger’s responsibility to pay by verbal confirmation or booking via the website. The flight fee and the options ordered are payable without deduction. When booking a passenger flight (by order or verbally), the fee is payable immediately afterwards. For bookings made at short notice, it is possible to pay the fee in cash on the spot.

The booking will be confirmed by the touch and go… flight school in writing, by telephone or by e-mail. If a gift voucher is booked, it will be sent to the customer immediately.

A transfer of chargeable benefits to another beneficiary is possible.

Agreed dates / weather:

Paragliding flights are weather-dependent. On the evening before the day of the flight, passengers must call the touch and go… flight school on +41 77 470 22 74 between 18:00 and 20:00 to find out the exact meeting point. If the weather is not flyable, the flight will be postponed by touch and go….

The touch and go… flight school expressly points out that even with fixed dates there is no entitlement to a flight if the weather conditions do not permit this. The flight area is determined by the touch and go… flight school or the tandem pilot depending on the weather conditions. The details of the flight are determined by the pilot. The duration of the passenger flight depends on the weather conditions.

Cancellation or contract amendment by the customer:

Flight bookings and reservations are binding and can only be cancelled up to 48 hours before the scheduled date. If the passenger does not appear or arrives late on the agreed date without notifying the pilot (or touch and go…) in time or if the passenger is under the influence of alcohol or drugs, there is no entitlement to a refund, compensation or reimbursement of any expenses.
If the passenger cancels the activity or leaves early, no refund will be given. All costs incurred (e.g. for mountain railways, booking fees) will be borne by the passenger.

Cancellation or contract amendment by the touch and go flight school …:

The pilot is always responsible for the execution of the flight. The pilot is entitled to cancel the flight, even at short notice, if he considers the passenger to be unsuitable due to his behavior, omissions or other actions that endanger or make it impossible to fulfill the contract.

If an event or parts thereof cannot be carried out due to force majeure, in particular due to unsafe weather and natural conditions and associated safety concerns on the part of touch and go… or its pilot(s), as well as due to official measures, strikes, short-term operational disruptions (e.g. at mountain railroads) or other reasons, touch and go… is entitled to cancel or interrupt the event, even at short notice.

Payments made will be refunded after deduction of services and expenses already utilized (e.g. for mountain railways, booking fees). It should be noted that it is in everyone’s interest to ensure a risk-free procedure. Decisions of the pilot are final. We expressly reserve the right to make changes to the event, in particular changes to the venue at short notice. touch and go… will endeavor to provide an equivalent replacement.

Liability & Insurance:

Paragliding is considered a non-risk sport in Switzerland, but an accident cannot be completely ruled out. Accident insurance is the responsibility of the participant. Each participant is responsible for taking out adequate health and accident insurance cover (including hang gliding accidents), e.g. in the event of an injury on the way to the meeting point or on the way to the launch site together with the organizer. With the accident insurance that is compulsory for Swiss employees, you are generally well covered.

Passengers act at their own risk.

In connection with the tandem flight service, touch and go… is only liable for damage caused by gross negligence and/or intent on its part. As far as legally permissible, the passengers release the tandem pilots from any liability that goes beyond existing insurances. If touch and go… transfers the execution to a partner company or a tandem pilot (freelancer), touch and go… is not liable for their actions and omissions. In particular, touch and go. .. is not liable for damages which are attributable to actions or omissions of the partner company or freelancer pilots which are not related to the contractually agreed service.

touch and go… is not liable for damage caused by the actions of third parties, other participants, force majeure, natural events, official orders, etc. or due to late return home. If a participant does not follow the instructions of the organizer or pilot etc., any liability on the part of touch and go…. is void.

Our pilots’ liability insurance covers CHF 5 million.

DATA PROTECTION

The customer agrees that his/her data may be electronically processed and stored by touch and go… within the scope of the contractual relationship. The data will not be passed on to third parties without authorization. The customer is advised that, given the current state of technology, the possibility of unauthorized persons gaining access to the transmitted data during the transmission process cannot be completely ruled out for all participants when data is transmitted via the Internet. The provider will destroy the customer’s personal data at the customer’s written request after the end of the service. Our complete privacy policy is available online at https://paragliding.ch/

COPYRIGHTS

touch and go… may use photo, audio and video material created during the event for its own purposes at any time (e.g. marketing, Facebook, Instagram, TikTok, newsletters, teaching materials, etc.). Customers agree to these images, videos and commercial use and do not claim compensation under any circumstances. touch and go… reserves all rights to the website https://paragliding.ch. It is forbidden to download, electronically store, process and sell the content or any part of the website without the written consent of the provider. touch and go… accepts no responsibility for the accuracy of the information provided on the https://paragliding.ch website or for typographical errors.

APPLICABLE LAW AND JURISDICTION

The contractual relationship shall be governed exclusively by Swiss law, to the exclusion of international agreements. The parties agree that Goldau SZ shall be the exclusive place of jurisdiction. However, the touch and go… flight school is entitled to assert its own claims at its own discretion at the customer’s place of residence or registered office.

Should one or more provisions of these GTC be or become invalid and/or incomplete, the invalid and/or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid and/or incomplete provision in terms of its effectiveness. The invalidity and/or incompleteness of a provision shall not affect the validity of the other provisions.

Participants from the USA or Canada expressly waive any jurisdiction in the USA or Canada and acknowledge that neither the touch and go… flight school nor its employees or partner companies or freelance tandem pilots agree to any jurisdiction in the USA or Canada.
