The company touch and go Paragliding GmbH, Parkstrasse 37, 6410 Goldau SZ (in short: touch and go…) (“we” or “our”) operates the website paragliding.ch (hereinafter referred to as the “website”). On this website you can find information about our paragliding school, register for flight training, trips or further training and book tandem flights. You can also keep your virtual flight logbook in the student area.

The following privacy policy informs our customers and suppliers as well as visitors to our website about the processing of personal data.

HOW DO WE COLLECT PERSONAL DATA?

We primarily receive personal data that you provide to us when you register for our services (training / travel / safety training / advanced training), book a tandem flight or fill out the contact form, as well as when you register for our newsletter. We also receive information when you manage your online flight logbook in the closed student area. We may also collect personal data when operating our website. Please read our information on this under “Further data processing operations”. We do not collect data exclusively via the website; if you order material from us or fill out the registration form in paper form, this information is also collected.

 

WHAT TYPES OF PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSES?

The following types of personal data may be collected by us. We rely on the use of personal data to provide our services. In such cases, this will be indicated on our website, in the disclaimers or as part of a contractual agreement. In addition, we may be legally obliged to collect certain personal data. If you do not provide us with this personal data, we may not be able to provide our services. We process your data in accordance with the purposes set out in this privacy policy. In doing so, we ensure transparent and proportionate processing.

Customers:

In connection with the provision of our contractually agreed services to our customers, we process the personal data that we require in order to provide the services and to protect our interests, and that we require on the basis of statutory or other binding regulations.

The personal data of our customers includes in particular the following personal data. The type of personal data may vary depending on the agreed service:

  • Personal master data (name, address, date of birth, etc.)
  • Contact details (mobile phone number, email address etc.)
  • Details of your emergency contact (name, telephone number)
  • Data about your training (logbook of your flights)
  • Information about your flying licence
  • Financial data (e.g. account details)
  • Information in connection with material sales such as paragliders (glider model, serial number, size, color, etc.), emergency parachutes (model, size, serial number, last pack), harnesses (model, serial number, size, color) and other material relevant to flight operations
  • History of the customer relationship
  • Newsletter registration: Name and email address

The personal data we receive that are particularly worthy of protection:

  • Passport number / travel document number, which may provide information about race or ethnic origin
  • Information about your dietary preferences (vegetarian / vegan etc.)
  • Information on weight and height and – if required for the respective service – on the health status of customers

Which data is processed in detail and how it is used depends largely on the services or purchases obtained or agreed in each case. Therefore, not all sections of this information will apply to you. The purposes for which we process the listed personal data are listed below:

  • For the processing and fulfilment of the contract that we have entered into with you. These are in particular the training to become a certified paraglider pilot, flying trips, safety training, advanced training and the organization of tandem flights.
  • The data relating to your flight material is required by us if, for example, safety notices need to be passed on to you or the next repacking of your rescue is due.
  • To safeguard our own interests:
    – Promoting our services, offers and products to existing and potential customers
    – Processing online enquiries, including responding to messages from individuals and requests for quotations
    – Settlement of receivables

Suppliers

If we order material from you or you provide services for us (e.g. paragliding gear maintenance), we process such personal data as is required for the processing of the business relationship.

We process the following personal data in particular:

  • Contact details (e.g. name, company name, telephone numbers, email addresses and other contact information)
  • Contract conditions
  • Financial data (e.g. account details)
  • Supplier relationship history

Below we list the purposes for which we process the personal data listed:

  • Contract: Processing and fulfilment of the business relationship and communication
  • Safeguarding our legitimate interests, such as maintaining, developing and ensuring the security and functionality of our information systems, applications and websites

 

FURTHER DATA PROCESSING OPERATIONS

Website and creation of log files

When you visit our website paragliding.ch, certain data is automatically stored on our servers or on servers of services that we purchase and/or have installed for system administration, statistical or backup purposes or for tracking purposes. These are:

  • the name of your internet service provider
  • your IP address (under certain circumstances)
  • Host Name
  • the version of your browser software
  • Type and the operating system of the computer used to access our website
  • the date and time of access
  • the website from which you are visiting our website
  • the search terms you used to find our website

The temporary storage of log files is essential for the operation of the website in order to guarantee its functionality and to ensure the security of our systems. This data cannot be assigned to a specific person and is deleted at the end of each session.

Tracking pixels / web beacons

We may use tracking pixels on our website. Tracking pixels – also from third parties whose services we use – are small 1×1 pixel images that are usually not visible and are automatically retrieved when you visit our website. Tracking pixels can be used to collect the same information as server log files. We use them for the same purposes as log files – data collection cannot be prevented.

Integration of content

Our website includes content from the providers listed below:

  • Location information via Google Maps
  • Calendar from Google Calendar
  • Videos from YouTube
  • Videos from Vimeo

Your IP address is stored for the purpose of using Google’s functions. This is usually transmitted to a Google server in the USA. We have no influence on this data transfer. For more information, see Google’s privacy policy. We use Google Maps, for example, to provide you with the location of meeting points. We use the Google calendar for the flight school calendar. This allows us to easily display important dates on our website.

Videos are integrated via a plug-in. As soon as you visit one of our pages equipped with a plug-in, a connection to the YouTube or Vimeo servers is established. The servers are informed which of our subpages you have visited. For more information, see the YouTube and Vimeo privacy policies. We integrate content from YouTube and Vimeo to make our website accessible to a wider audience. This is in our legitimate interests.

Social media plug-ins

We use social media plug-ins from Facebook, Instagram, TikTok and WhatsApp. For more information, please refer to the Meta Privacy Policy at https://www.facebook.com/privacy/policy/ and the TikTok privacy policy at https://www.tiktok.com/legal/page/eea/privacy-policy/en.

We use social media platforms to make our website accessible to a wider audience. We have no knowledge of what data is transmitted during use.

Tracking tool Google Analytics

We use Google Analytics, a service provided by Google Ireland Ltd, Google Building Gordon House, Barrow St, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA; both together “Google”, whereby Google Ireland Ltd. is responsible for the processing of personal data, for the purpose of designing and continuously optimizing our website in line with requirements.

Google uses cookies, which are stored on your device and enable your use of the website to be analyzed. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. We have added the code “anonymiseIP” to Google Analytics. This ensures that all data is collected anonymously. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

We need Google to evaluate the data collected so that we can get an idea of the visits and user behavior on our website. This enables us to improve our services and website content as well as its design. You have the option of preventing the storage of cookies by adjusting the settings in your browser accordingly or you can also deactivate Google Analytics by downloading and installing the Google browser add-on.

Google Fonts

We use so-called web fonts provided by Google on our website for the standardized display of fonts. When you access one of our pages, your browser loads the required web fonts into your browser cache in order to display texts and fonts correctly. This allows Google to know that our website has been accessed via your IP address. We use Google Fonts for a uniform and appealing presentation of our website.

Google reCaptcha

We use Google reCaptcha on our website. This is a service provided by Google LLC in the USA. The purpose of reCaptcha is to check whether the data input on our websites (e.g. in a contact form) is made by a human or by an automated program. For this purpose, reCaptcha analyses the behavior of the website visitor based on various characteristics. Cookies are also used for this purpose, which are set by the service provider. This analysis begins automatically and runs completely in the background as soon as the website visitor opens the website. Website visitors are not informed that an analysis is taking place. Google can analyze all information from the contact form pages (including the IP address, time spent on the website by the website visitor or mouse movements made by the user). The data collected during the analysis is forwarded to Google. We use this service to protect online forms on our website. Data processing takes place on the basis of your consent. The reCaptcha service is used in accordance with the Google Privacy Policy and Terms of Use.

Knack

We have built an application with the Knack system for our students. With this system in the student area, we ensure that school operations run smoothly.

The following data is stored in Knack:

  • Personal master data (name, address, date of birth, etc.)
  • Contact details (mobile phone number, email address etc.)
  • Details of your emergency contact (name, telephone number)
  • Data about your training (logbook of your flights)
  • Information about your flying licence
  • Flying equipment
  • Last repacking of the emergency parachute
  • Various internal information that is recorded during your training regarding your training progress (e.g. date of 1st high flight / internal tests / number of high flights etc.)
  • Registration for training days, possible car sharing etc.
  • Logbook of your flights

Below we list the purposes for which we process the personal data listed:

  • For the processing and fulfillment of the contract we have entered into with you
  • So that we can inform you about the upcoming maintenance of your emergency parachute
  • To safeguard our own interests:
    – Internal analysis

After you have completed your training, we will retain this data for internal analysis purposes. We also assume that you wish to continue accessing your data (such as the flight logbook). If you wish and inform us in writing, we can anonymize your data within the Knack system, but this means that you will no longer be able to access your account/data and the anonymization cannot be reversed.

Data processing is based on your consent. Knack is used in accordance with the Knack privacy policy https://www.knack.com/privacy/.

Cookies

Cookies are files with small amounts of data that may contain an anonymous unique identifier. Cookies are sent from a website to your browser and stored on your computer’s hard drive. Some of the cookies we use are automatically deleted when you leave our website. Other cookies remain stored on your end device until you delete them or they expire. These cookies make it possible to recognize your browser the next time you visit our website.

We use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our service.

Newsletter

You can subscribe to our free newsletter via our website. With the newsletter you will receive information about new articles, events and offers.
When you register for the newsletter, we collect your e-mail address and any other contact details. We need these for dispatch and verification purposes.
We are authorized to pass on your data to third parties for the technical processing of the newsletter.
We store your data for as long as you are registered for the newsletter. If you unsubscribe, your data will be stored for as long as is necessary to register your cancellation.
By submitting the newsletter registration form, you consent to the processing of your data. You agree to receive our newsletter on a regular basis.

Newsletter analytics: We use an analytics service to measure the reach of our newsletter. It measures how often the newsletter is opened and which links the recipient follows.

 

ON WHAT LEGAL BASIS DO WE PROCESS PERSONAL DATA?

We process your data in good faith and in accordance with the purposes set out in this privacy policy. In doing so, we ensure transparent and proportionate processing. The collection and use of personal data in the context of our business activities and for the provision of our products and services may be legally justified as follows:

  • Contract: We may process personal data if this is necessary for the processing and fulfilment of our contractual obligations.
  • Consent: Personal data may be processed by us if you have voluntarily consented to the processing at the time of providing your personal data.
  • Legitimate interests: Personal data may be processed by us if this serves our legitimate interest and we have previously determined the processing to be appropriate, reasonable and balanced, provided that your interests do not outweigh this. These interests include:
    – Provision of services and products – to provide the services and products ordered by our customers
    – Marketing – to provide timely market insights and expertise and to communicate offers and proposals that we believe will be of interest to you

You may be required to provide us with certain personal data so that we can enter into a business relationship. Without such data, we are normally unable to fulfil a contract.

 

DO WE PASS ON YOUR PERSONAL DATA TO THIRD PARTIES?

In certain cases, we pass on personal data to trusted third parties if this is necessary for the provision of our services and products. These are in particular:

  • Freelance flight instructors that we use for training
  • Freelance tandem pilots who carry out tandem flights for us
  • IT service provider (web hosting, support, cloud services, website design, etc.)
  • Provider of advertising services (newsletter)

We ensure that these third parties comply with data protection requirements and treat your personal data confidentially.

With regard to the transfer of data to recipients outside our company, it should first be noted that we only pass on necessary personal data in compliance with the applicable data protection regulations.

Under these conditions, recipients of personal data may be, for example:

  • public bodies and institutions (e.g. tax authorities, law enforcement authorities) in the event of a legal or official obligation
  • Credit and financial services institutions (processing of payment transactions)
  • Tax consultant, business and payroll tax/company auditor (statutory audit mandate)

Passing on to partners and co-operation companies

We work with partners in individual areas who have placed their offers on our website. You will be able to recognize that this is a third-party offer.

If you make use of such an offer, we process your personal data for the purpose of forwarding it to these partners or co-operation companies (e.g. name, contact details, communication, etc.). These partners and co-operation companies are independently responsible for the personal data they receive. Their data protection provisions apply.

Do we transfer your data abroad?

Under certain circumstances, your personal data may be transferred to companies abroad as part of order processing. These companies are obliged to protect data to the same extent as we are. The transfer may take place worldwide. One example of the transfer of your data is air travel so that we can fulfil our contractual obligations.

If the level of data protection does not correspond to that in Switzerland, we carry out a prior risk assessment and contractually ensure that the same level of protection is guaranteed as in Switzerland (e.g. by means of the new standard contractual clauses of the EU Commission or other legally prescribed measures). If our risk assessment is negative, we will take additional technical measures to protect your data.

 

WHAT RIGHTS DO YOU HAVE?

If we process personal data about you, you have the rights listed below.

Information: You can request information about the data we have stored about you at any time. We ask you to send your request for information together with proof of identity to the data protection officer.  The processing of your request is subject to the statutory processing period of 30 days. However, we may extend this period due to a high volume of requests, for legal or technical reasons or because we need more detailed information from you. You will be informed of the extension in good time, at least in text form.

Rectification: You have the right to have your personal data corrected by us if you believe that it contains incorrect or incomplete information about you.

Erasure: You have the right to have your personal data erased by us if you withdraw your consent to its processing or if we no longer need the personal data for the original purpose of its use and are not obliged to retain it. We may reject the request if statutory provisions oblige us to retain the data for a longer period or to retain it unchanged or if your request conflicts with a legal authorization.

Restrictions on processing: You have the right to temporarily restrict the processing of your personal data by us if you doubt the accuracy of the personal data or wish to restrict the use of the personal data instead of having it deleted.

Right to object to marketing: You have the right to object to the use of your personal data by us for marketing purposes. We may need to retain some basic information in order to fulfil your request not to engage in marketing activities.

Right to withdraw consent: You have the right to withdraw your previously given consent to the processing of your personal data for one or more specific purpose(s). This does not affect the lawfulness of processing that took place prior to the withdrawal. In the event of revocation, we may no longer be able to provide you with certain services or products, which we will point out.

 

HOW DO WE PROTECT YOUR PERSONAL DATA?

We use suitable technical and organizational security measures to protect your personal data stored by us against manipulation, partial or complete loss and against unauthorized access by third parties.

Our security measures are continuously improved in line with technological developments.

We also take data protection within the company very seriously. Our employees and the service companies commissioned by us are obliged to maintain confidentiality and to comply with data protection regulations.

Within our website, we use the SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser.

 

HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We only store personal data for as long as is necessary to fulfil the individual purposes for which the data was collected.

Data that we store when you visit our website is stored for twelve months. An exception applies to analysis and tracking data, which may be stored for longer.

We store contract data for longer, as we are obliged to do so by law. In particular, we must store business communications, concluded contracts and accounting documents for up to 10 years. If we no longer need such data from you to perform the services, the data will be blocked and we will only use it for accounting and tax purposes.
